Welcome to Website In A Week™, a service provided by 7 Days to Launch Pty Ltd (“we,” “us,” “our”). The following Terms and Conditions ("Terms") govern your use of our website (the “Site”) and our services. By accessing the Site or engaging in our services, you agree to these Terms in full. If you do not agree with any of these Terms, please do not use the Site or engage our services.

1. Intellectual Property and Licensing
- Trademark: Website In A Week™ is a trademark of 7 Days to Launch Pty Ltd, © 2024. All rights are reserved.
- Ownership of Materials: All content, designs, code, graphics, text, videos, and other materials on the Site or produced in connection with our services are owned by or licensed to 7 Days to Launch Pty Ltd and protected by Australian copyright, trademark, and other intellectual property laws. Ownership of client design is owned by them upon receiving final payment.
- Limited Licence: We grant you a limited, non-exclusive, and non-transferable licence to access and use the Site solely for personal and informational purposes related to our services. Any other use, including reproduction or modification, is strictly prohibited without our prior written consent.
2. Use of Website and Services
- Site Purpose: The Site is intended for informational purposes and to facilitate engagement with our services. You may not use the Site for any illegal or unauthorised purposes.
- Eligibility: By accessing the Site, you confirm that you are at least 18 years of age and legally capable of entering binding agreements.
3. Scope of Services and Pricing
- Scope of Services: We offer website design, development, launch and other related services that can be tailored to client needs, as outlined on the Site or in individual agreements. The scope of each project is specified in a client proposal or agreement.
- Pricing: Project fees are determined based on each client’s requirements and scope of work. Prices are provided in Australian Dollars (AUD) and exclude GST unless otherwise specified.
- Scope Adjustments: Changes requested after the project has commenced or specific project phases have been signed off by the client may incur additional costs and alter the delivery timeline.
4. Payment Terms
- Deposit: A non-refundable deposit may be required to initiate the project, as outlined in the client agreement.
- Final Payment: The final balance is due upon project completion and before the transfer of ownership. Full payment must be received for the final website handover. Any designs and intellectual property is signed over to the client at this time.
- Post Final Payment Work: After the website has launched / the final payment has been received, any future questions, features or asks are to be scoped, quoted and agreed accordingly. Maintenance and additional work after the final payment has been received are not covered by the payment of the website design, develop and launch scope.
- Refund Policy: All payments, including deposits, are non-refundable. If the project is cancelled by the client after it has commenced, payments will be retained to cover work completed and costs incurred.
5. Project Timelines and Client Responsibilities
- Project Timelines: We aim to complete each project within the agreed 7 day timeframe. Timelines are subject to your cooperation, including the timely provision of resources, approvals, and feedback.
- Client Delays: Any delay of more than 12 hours in providing requested resources or feedback may extend the project timeline by one day per delay. Delays impacting completion dates may incur additional costs.
6. Domain, Hosting, and Ownership
- Domain and Hosting: Upon project completion, we transfer the website to your Webflow account, ensuring your complete ownership. Clients/You are responsible for all hosting fees and account management directly through Webflow or other third-party providers.
- Domain Propagation: Domain setup and propagation can take up to 48 hours, depending on external factors. Any delays due to domain propagation are outside our control and are not included in the project’s timeline.
- Transfer of Ownership: Once full payment is received, ownership rights to the final website will be transferred to your designated Webflow account.
7. Client Content and Placeholder Use
- Content Provision: All required content, including images, text, and brand assets, must be provided by the client at project initiation. If not provided, we will use placeholders to maintain project progress. Placeholder content does not affect project completion or handover.
- Accuracy and Legality: The client is responsible for ensuring that all provided content is accurate, legally compliant, and free of third-party rights. We are not liable for any issues arising from client-provided content.
8. Functionality, Features, and Exclusions
- Standard Features: Our service includes basic functionality and integrations. Advanced web applications (e.g., login/logout, complex databases, and custom animations) fall outside the standard scope. If additional functionalities are requested, we will discuss revised timelines and costs.
- Exclusions: The project scope does not include any maintenance or advanced development work post-launch unless explicitly agreed upon.
9. Limitation of Liability
- Disclaimer: To the fullest extent permitted by Australian law, we exclude all warranties and representations, including implied warranties related to merchantability, fitness for purpose, and non-infringement.
- Limited Liability: Our liability to you for any claims arising from the use of the Site or our services is limited to the total fees paid by you for the specific project. We are not liable for indirect or consequential losses, including loss of income, revenue, or data.
10. Indemnity
- Client Indemnity: By using our services, you agree to indemnify, defend, and hold us harmless from any claims, damages, losses, or expenses arising from your use of the Site or any breach of these Terms, including any claim related to the accuracy, legality, or appropriateness of your content.
